When and where can a manipulation be filed?

19 CFR 19.11

Merchandise under In-Bond status cannot be manipulated anywhere other than in a bonded warehouse.

Manipulation is filed for merchandise under In-Bond status in order to break seal on a bonded conveyance (ocean containers), and to open cartons in order to verify quantities, marks and/or labeling before exporting to another country.

If the In-Bond is manifested for the inner quantity (cartons), the shrink wrap can be broken down in order to review cartons' labeling—no manipulation is required.

If the In-Bond is manifested for the outer quantity (pallet), you may not manipulate the shrink-wrap since the whole pallet is considered bonded—manipulation is required.

How can merchandise In-Bond be moved from one port to another?

19 CFR 18.3

Only bonded carriers are allowed to transport In-Bond merchandise from one port to another.

Transfer from one bonded carrier to another requires a report of arrival on the original bonded carrier, and a new In-Bond document must be filed by the subsequent bonded carrier.

Can I pull from an FTZ Warehouse as In-Bond merchandise?

FTZ Manual Section 9.13

Yes: in order to retrieve merchandise from an FTZ (Foreign Trade Zone) warehouse, an In-Bond or a consumption entry must be filed.

If filed, an In-Bond from an FTZ warehouse will be the only exception where it’s required for a Shipper EEI Transmission to be processed.

What happens when there is a discrepancy found in In-Bond merchandise?

As stated in 19 CFR 123.9(c): all shortage and overage found in the bonded warehouse must be reported to all parties involved. A root cause of the shortage/overage must be determined with the supply chain (bonded carrier, bonded warehouse and importer or owner of the goods).

When the Discrepancy Report is authorized by CBP, the bonded warehouse is then authorized to revise documentation and release the cargo to its final destination.
